Incorporación del delito de ecocidio en el Estatuto de Roma de la Corte Penal Internacional para sancionar la destrucción de la Amazonía
Abstract
The objective of this research was to investigate: What legal measure should the international community adopt to end the impunity of those responsible for the Amazon ecocide?
The descriptive-analytical method decided that the Amazon is home of the largest basin and the humid tropical forest on the planet with a great biological and cultural biodiversity, that provides ecosystem services such as: oxygen, fresh water, climate regulation, among others. However, due to human and economic causes like: agriculture, livestock, mining, extractivist activities and others, it is alarmingly being pulled and deforested with a serious impact on biodiversity, hydrological cycle, food security and global climate change; putting at risk the health and life of indigenous peoples and nations, but also of future generations of humankind.
Since there is a legal loophole in the Rome Statute of the International Criminal Court, it is relevant to incorporate the crime of ecocide and classify it as a crime against nature and against humanity, in order to punish those responsible for the Amazon ecocide and protect the rights of the Mother Earth, the right to health and life of indigenous peoples and the human right to a clean, healthy and sustainable environment.
